TO: All persons who purchased Leatherman Tool Group, Inc. ("Leatherman") tools in California from April 2, 1997 to the present which were contained in packages on which an unqualified "Made in U.S.A." or "U.S.A." representation was made.

On February 4, 2003 the Court certified a class consisting of two sub-classes, defined as: (1) CLRA Class - All individuals who purchased Leatherman tools in California for personal, family, or household purposes from April 2, 1998 to the present which were contained in packages on which an unqualified "Made in U.S.A." or "U.S.A." representation was made; and (2) UCL Class - All persons who purchased Leatherman tools in California from April 2, 1997 to the present which were contained in packages on which an unqualified "Made in U.S.A." or "U.S.A." representation was made.

Plaintiffs assert claims against defendant Leatherman for violations of California's Unfair Competition Law ("UCL"), violations of California's Consumers Legal Remedies Act ("CLRA"), and for false and misleading advertising. Plaintiffs allege Leatherman represents that Leatherman tools are "MADE IN U.S.A." when those tools actually contain parts which are made outside the United States. Plaintiffs seek monetary and injunctive relief from Leatherman. Leatherman denies all liability and contends that its "Made in U.S.A." representations are accurate and truthful. The Court has not ruled on the merits of Plaintiffs' claims or Leatherman's defenses.

If you are a class member and do NOT want to remain a member of the class, you may elect to exclude yourself ('OPT-OUT'). To opt-out, you must mail a written request, postage prepaid, to Leatherman Tool Litigation c/o The Rossbacher Firm, 811 Wilshire Boulevard, Suite 1650, Los Angeles, California 90017. The request must be postmarked on or before May 25, 2003, and should include your full name, address, telephone number and signature, and a statement of the number of Leatherman tools you purchased, if available. If you opt-out of this action, you will not share in any monetary relief that might be provided to class members and you will not be bound by any decision in this lawsiut favorable to Leatherman. If you do not opt out of the action as instructed above, you will automatically be included and bound by any determination of the Court, whether favorable or not, and any claim you may have against Leatherman arising from Leatherman's conduct as alleged by plaintiffs will be ended by the judgment in this action and may not be presented in any other lawsuit. If you choose, you may enter an appearance individually or through your own counsel at your own expense no later than May 25, 2003 by (a) filing a Notice of Appearance with the Clerk of the Court located at 600 South Commonwealth Avenue, Los Angeles, California 90005, and (b) mailing the Notice of Appearance to Plaintiffs' counsel identified below and to Leatherman's counsel, Fredrick A. Rafeedie, Jones, Bell, Abbott, Fleming & Fitzgerald, L.L.P., 601 South Figueroa Street, Twenty-Seventh Floor, Los Angeles, California 90017.
